Bloggers.com.au Terms of Service (TOS)

By accessing and/or using this site you evidence your approval and acceptance of the following terms:

Introduction and General Information

Bloggers.com.au aims to provide timely, useful information to entrepreneurs that own websites looking for quality written articles for the purpose of providing great content to their website visitors by way of allowing writers/sellers to upload original articles for sale. Bloggers.com.au is a Pacific Octane Pty Ltd marketplace.

Ownership and Restrictions

All proprietary materials contained in this site are the copyrighted property of Bloggers.com.au. Bloggers.com.au and all titles, characters, names and graphics are copyrights of Bloggers.com.au. To reproduce, republish, upload, post, transmit, modify, distribute or publicly perform or display material from this site, you must first obtain written permission from Bloggers.com.au via the purchase of an article.

Writers/Sellers

1. Writers, known as Sellers, are allowed to upload and publish content based on their original creativity and must not at anytime spin, rewrite or alter another piece of content from the internet or by any other source. By uploading the content in the format of a .txt file, the writer/seller acknowledges that they are relinquishing all rights to the article to Bloggers.com.au. The article and all content submitted as a summary of the article are property of Bloggers.com.au and Bloggers.com.au can use the content in any fashion deemed appropriate by Bloggers.com.au.

2. Sellers may at anytime adjust the pricing of their articles before there has been a first purchase. Once there has been an initial purchase of the article, the seller must contact Bloggers.com.au in order to have a special condition placed on the article in order to lower the price for any reason.

3. All sellers herein are considered to be independent contractors and responsible to their own income tax. All payments will be reported and must therefore be claimed by the seller to the Australian Tax Office. By each seller being an independent contractor, Bloggers.com.au must pay the seller their full commission entitled, which is 75% of the revenue generated by the sale of articles on behalf of the seller, and therefore the payment is inclusive of GST.

4. All sellers must remain annonymous within the Bloggers.com.au marketplace. By any seller placing direct contact information into any article in any format will be cause for immediate termination of membership as well as a forfieture of all payments due to the seller with no recourse.

Buyers

1. Buyers are allowed to download the article for use as is deemed appropriate by their company for their own private use. The buyer in no way owns the right to resell, redistribute, rewrite, trade and/or recirculate in anyway any article purchased from Bloggers.com.au.

2. In the event that a buyer is suspected of redistributing their article content via direct sales, trade, barter or any other form of distribution, the buyer account will be suspended whilst their is an investigation. The investigation of breach of agreement may take up to 6 months and at no time may the buyer regain access under any alias and/or another account to proceed doing business with Bloggers.com.au whist their investigation is ongoing.

3. If after the investigation the buyer is found to not be in breach of these terms and conditions, the buyer account will be unsuspended and the buyer can begin trading again as per their discretion. If after the investigation is concluded and the buyer is found to be in breach of these terms of service, a letter will be issued to the buyer by Bloggers.com.au to cease all use of any content purchased via the Bloggers.com.au marketplace. In the event that the buyer continues to use property purchased from the Bloggers.com.au marketplace, then legal action will be taken against the buyer.

Disclaimer of Warranties and Damages; Limitation of Liability

Bloggers.com.au makes no representation that the materials contained in the site are appropriate or authorised for use in all Countries, States, Territories provinces, county or any other jurisdictions. If you choose to access this site, you do so on your own initiative and risk and are responsible for compliance with all applicable laws. Bloggers.com.au does not warrant any claim or subject matter made by any seller within the Bloggers.com.au marketplace. It is at the buyer discretion that they use the content provided on their website.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, BLOGGERS.COM.AU AND ITS AFFILIATED COMPANIES DISCLAIM ALL WARRANTIES , EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BLOGGERS.COM.AU DOES NOT WARRANT OR REPRESENT THAT THE INFORMATION CONTAINED IN THE SITE IS ACCURATE, COMPLETE, CORRECTLY SEQUENCED, RELIABLE OR TIMELY, OR THAT THE SITE WILL BE UNINTERRUPTED OR FREE OF ERRORS AND/OR VIRUSES. IN NO EVENT SHALL BLOGGERS.COM.AU AGGREGATE LIABILITY TO YOU FOR ANY LOSS, DAMAGE OR CLAIM RELATED TO OR ARISING OUT OF THIS SITE EXCEED THE TOTAL AMOUNTS PAID BY YOU TO THE BLOGGERS.COM.AU FOR ACCESSING THIS SITE, IF ANY.

Updates

Bloggers.com.au may amend or modify this Agreement or impose new conditions at any time. Any use of the site by you after such update shall be deemed to constitute acceptance by you of such amendments, modifications or new conditions.

Termination

This agreement is effective until terminated by the Bloggers.com.au for any reason, with or without notice. Upon any termination of this agreement, you will immediately discontinue your use and access of the site.

Miscellaneous

This agreement will be governed by NSW Australian law without effect to any principles of conflicts of laws. If any provision of this agreement is held by a court of competent jurisdiction to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
